In Kansas, we have driving laws that specifically indicate how fast you can travel on different roads and highways. Negligence per se means there is legal liability for damages predicated on a violation of a statute. The Kansas Supreme Court has issued guidance by stating the elements of negligence per se: 1) A violation of a statute, ordinance or regulation, and 2) the violation must be the cause of the damages resulting therefrom. For the rules of the road (statutes setting forth driving rules like speed limits), these statutes automatically establish an individual right of action for an injury arising out of the violation of the statute. In simple language, if the other driver was speeding, then they are negligent.
