What Are Common Spinal Cord Injuries Caused By Car Accidents?
Spinal cord injuries from a car accident are serious life-changing injuries. These injuries include:
- Complete spinal cord injury – The spinal cord has been completely severed, resulting in total paralysis (loss of feeling or movement) below the injury area.
- Partial spinal cord injury – The spinal cord has been partially cut, allowing person to move part of their body below the injury area.
- Fractured vertebrae or fractured spine – There is a fracture in one or more of the vertebral bones in the spine. Some of the most common injuries are spinal compression fractures, which cause the vertebrae to collapse and can cause pieces of bone to press on the spinal cord and nerves. The vertebral body height is reduced, changing the overall functioning of the spine.
Complete spinal cord injuries are classified based on the location in the spine where the injury took place. The resulting paralysis is labeled:
- Paraplegia – Paralysis in the legs and lower part of the body. This typically is due to thoracic or lumbar spinal injuries (injuries to the middle or lower spine).
- Quadriplegia – Paralysis affecting the arms, hands, and legs. This is a common result of cervical spinal injuries (injuries to the top of the spine).
What Treatment Is Needed for a Spinal Cord Injury After an Auto Accident?
With these severe injuries and after a diagnosis is made, spinal cord surgery is often performed in the initial hospitalization after the wreck. For small compression fractures, surgery may not be necessary and instead it is common to stabilize the back with a back brace. For larger compression fractures, a typical surgical procedure is kyphoplasty, which involves injecting cement into the vertebrae to stabilize the bone. For direct injuries to the spinal cord, surgery is attempted to free up the spinal cord with removal of pieces of the vertebrae that may be impinging on the cord and stabilization of the spine in that area.
Because of the loss of function to the body, with any paralysis, there is often lengthy initial hospital stays, and later lengthy rehabilitation hospital admissions. These admissions allow time for the body to heal, but that healing is assisted with physical therapy, occupational therapy, physical medicine and neurological and orthopaedic specialists, and medication management.
Should I Hire a Lawyer If I Sustained A Spinal Cord Injury From an Auto Accident?
Spinal cord injuries cause lifelong injuries with serious ramifications for you and your family. These injuries typically have many future ramifications, including future lost earnings, and future medical needs. Our injury lawyers have years of experience in proving your past and future damages. These cases typically involve many experts including lifecare planners, vocational experts, economists, and others. We will do everything possible to prove the full extent of your damages, including getting the best experts possible.
What Makes Spinal Cord Injuries From Car Wrecks Difficult?
These life shattering injuries are difficult for many reasons. Long term hospital admissions prevent you from being able to handle normal daily life activities. Your income stops due to the inability to work. You have to rely on friends and family for support. You have to figure out how all the medical expenses will get taken care of. You have to figure out your new future including how to get the future medical care you need and how you are going to support yourself and your family. Many experts will be needed to quantify your future damages. Despite these huge issues, the insurance company is taking ridiculous positions:
- According to the insurance adjuster, the at-fault driver who caused your spinal cord injury denies causing your crash or argues you are comparatively at fault
- The insurance adjuster is unwilling to advance funds from your future settlement and is unwilling to disclose how much insurance coverage is available
- The other driver’s insurance company delays handling your claim because they want information about your past and they want documentation of your auto and health insurance payments and write-offs
The damages are often extremely high in auto accidents involving spinal cord injuries. The medical bills for procedures like spinal fusion surgery, plus other accident-related expenses (lost income, future lost earning capacity, future medical bills, pain and suffering, etc.) can often add up to thousands or even millions of dollars. Insurance companies on these cases typically either assign their highest trained adjusters or get their lawyers involved quickly, all in an effort to try and limit their payouts.
Our attorneys know how to help. We know how to negotiate effectively with insurance companies. We will spend the money necessary to get qualified experts to prove all the damages. When the insurance company doesn’t fairly value the case, we file a lawsuit on your behalf for your spinal cord injury.
